Notification Period. Except as provided in clause 2.9 the contract of employment may be terminated by the Employer or employee giving notice as provided in the following table: Not more than 1 year At least 1 week More than 1 year but not more than 3 years At least 2 weeks More than 3 years but not more than 5 years At least 3 weeks More than 5 years At least 4 weeks Provided that where the employee is aged over 45 years and has more than two years continuous service, the period of notice shall be five weeks. Where mutually agreed a shorter period of notice may be given without payment, or forfeiture of payment in lieu. Summary Dismissal. The Employer may summarily dismiss an employee deemed guilty of gross misconduct or neglect of duty and the employee shall not be entitled to any notice or payment in lieu of notice. Normal disciplinary procedures do not apply in this case.
