Nonconformity. To the extent that Licensor determines that the Project as constructed, renovated or refurbished, furnished or equipped does not conform to the Design Standards agreed to by the parties consistent with this Addendum, or to the approved Plans, Licensor shall provide written notice thereof to Licensee providing a detailed description of such nonconformity. Upon receipt of such notice, Licensee shall promptly (i) correct (or cause to be corrected) such nonconforming work, (ii) commence and diligently pursue a correction to such nonconforming work, or (iii) provide Licensor with adequate assurances that such nonconforming work will be promptly remedied within thirty (30) days after receipt of written notice from Licensor.
Nonconformity. (a) When major non conformity occur Keyn Certification undertakes a “special follow up visit”, which is charged at Keyn Certification’s current rates.
Nonconformity. At any breach of the provisions in this DPA, the GDPR or other applicable regulation, the Controller may demand that further processing by the Processor or any sub processor shall cease with immediate effect, and may initiate necessary measures to protect the data. A breach of the provisions in this DPA may be considered as material breach, cf. the provisions regarding breach in the Contract. Any compensation claim resulting from one of the Parties’ violation of law, regulations or obligations set out in this DPA shall be resolved in accordance with Article 82 of the GDPR. Item 6 in the Contract about the Consultant´s liability will also apply.
Nonconformity. In the event that the HP-OMS Software or Developed Materials do not comply with the applicable specifications and criteria set forth in this Agreement, and/or materially and adversely affect the Services provided hereunder and subject to subsection (g) above, HP-OMS shall repair in accordance with the Service Levels or replace such HP-OMS Software or Developed Materials with conforming HP-OMS Software or Developed Materials. Nonconformity. In addition to the foregoing, in the event that the Supplier Owned Software do not Comply with the specifications and criteria set forth in this Agreement (as applicable), and/or materially and adversely affect the Services provided hereunder, Supplier shall expeditiously repair or replace such Software or Material with conforming Software or Material.
Nonconformity. All items ordered will be subject to final inspection and approval, at Buyer’s election, at Seller’s plant or other Buyer- designated location or, if services, at the site at which such services are to be performed. If any of the items are found at any time to be not in conformity with the requirements of this Order, Buyer shall also have the right to reject and return, or to hold such items for Seller's instructions at Seller's risk and expense or, in the case of services, to have such services performed anew by Seller at no cost or expense to Buyer. However, such items are not to be replaced or such services are not to be performed anew without Buyer's written authorization.
Nonconformity. 6.1 In the event that the Purchaser identifies a non-conforming product the Purchaser may issue a SCAR to the Supplier. In this event, the Supplier shall provide immediate remediation and provide response to the SCAR with root cause and corrective action within the timeline specified by The Purchaser. Escalation may result if response(s) is not timely.
Nonconformity. In the event that the Amdocs owned software, developed materials or the Amdocs software package do not comply with the specifications and criteria set forth in this agreement, and/or materially and adversely affect the services provided hereunder, Amdocs shall repair in accordance with the provisions of Schedule G or replace such software or material with conforming software or material. Nonconformity. Within ten (10) days after delivery of the Goods to Purchaser in accordance with this Purchase Agreement, Purchaser must give detailed written notice to DCE of any claim based upon the condition, quantity or grade of the Goods sold or of any claimed nonconformity with the Purchase Order. The failure of Purchaser to comply with this requirement shall constitute irrevocable acceptance by Purchaser of the Goods delivered and shall bind Purchaser to pay DCE the full price for such Goods.
