Common use of Non-Waiver of Breach Clause in Contracts

Non-Waiver of Breach. The failure of the Landlord or Tenant to insist upon strict performance of any of the covenants and agreements of this Lease, or to exercise any option herein conferred in any one or more instances, shall not be construed to be a waiver or relinquishment of any such, or any other covenants or agreements, but the same shall be and remain in full force and effect.

The failure of the Landlord Owner or the Tenant to insist upon the strict performance of any of the covenants and agreements of this Lease, Lease or to exercise any option herein conferred in any one or more instances, shall not be construed to be a waiver or relinquishment of any such, other covenants of this Lease or any other covenants or agreements, but subsequent default of the same covenant. All such covenants shall be and remain in full force and effecteffect for the term of this Lease.
