Non-continuous Shift Clause Samples
The Non-continuous Shift clause defines the conditions under which an employee's work shift may be split into separate, non-consecutive periods within a single workday. Typically, this clause outlines how breaks between work periods are scheduled, the maximum allowable gap between shifts, and any compensation or notification requirements for such arrangements. Its core practical function is to provide flexibility in scheduling while ensuring that both employer and employee understand the expectations and limitations of non-continuous work periods, thereby preventing misunderstandings and potential disputes over work hours.
Non-continuous Shift a) An employee on non-continuous shift is entitled to an unpaid meal break of not more than thirty (30) minutes each shift.
b) In the absence of any custom or agreement, employees will not be required to work more than five (5) hours continuously without a meal break.
c) Where a non-continuous shift worker is instructed by Utilities Management to work in excess of five (5) continuous hours without a meal break, the time worked from the end of the fifth hour until a meal break is taken or work ceases will be paid at time and a half (1.5x) of the employee’s ordinary rate in addition to the appropriate shift allowance pursuant to subclause 9.
3.1. provided that where a non-continuous shift worker is rostered to work on a Sunday or Public Holiday and is instructed to work beyond five (5) continuous hours without a meal break, the penalty rates applicable (Sunday: 2x ordinary rate; Public Holiday: 2.5x ordinary rate) will continue until the employee ceases work.
d) Employees are entitled to a paid break of at least ten (10) and up to twenty (20) minutes at a time to be agreed. The time and duration of the break will continue according to the practice within each workplace as at 1 September 1999.
Non-continuous Shift work Where an employee has worked on only one or two of such types of shift during the period of 12 months referred to such an employee shall not be regarded as a continuous shift worker for the purposes of this clause.

(a) The overtime rate for Non-Continuous Shift Workers applicable to any work carried out from Monday to Saturday will be calculated at time and one-half for the first three hours worked in addition to a normal shift and double time in respect of any additional hours worked after the expiry of the additional three hour period EXCEPT when the time is worked:
(i) by arrangement between the employees themselves, or
(ii) for the normal rotation of shifts, or
(iii) on a shift to which an employee is transferred on short notice because of changed work requirements beyond the control of Hydro Tasmania.
(b) If a relieving employee has given Hydro Tasmania at least eight hours notice of their absence from work, and the employee who should be relieved is not relieved and is required to continue to work, the unrelieved employee will be paid double time.
(c) The overtime rate for Non-Continuous Shift Workers to any work carried out on a Sunday will be calculated at double time.

a) A non-continuous shift worker is entitled to annual leave in accordance with subclause 8.1.1.
b) A non-continuous shift worker who has not been on non-continuous shift for the full period of an entitlement will be paid the higher of • a loading of 17.5%, or • a proportionate amount of the roster average shift allowance in respect of each complete period of 28 days worked during the entitlement period.

(Rotating): - means work performed by consecutive shifts of Team Members through the 24 hours of each day, of at least five consecutive days without interruption, except during breakdowns or meal breaks or due to unavoidable causes beyond the control of Iplex. Team Members engaged on non-continuous shift work are rostered to rotate between shifts.

b) Excluding time spent on worker's compensation, continuous unpaid absences in excess of one (1) calendar month are not counted towards the accrual of annual leave entitlements.
c) A non-continuous shift worker who has not been on non-continuous shift for the full period of an entitlement will be paid the higher of; • a loading of 17.5%; or • a proportionate amount of the roster average shift allowance in respect of each complete period of twenty eight (28) days worked during the entitlement period. a) Continuous shift workers are defined as shift workers for the purpose of the National Employment Standards. A full time continuous shift worker is entitled to five (5) weeks annual leave per year. In practice this means continuous shift workers on eight (8) or twelve (12) hour shifts will be given 192 hours paid annual leave each year.
