NOISE REPORT. The following warning clauses may be required to be included in all offers of purchase and sale, in accordance with the Detailed Environmental Noise and Vibration Report prepared by ▇.▇. ▇▇▇▇▇▇▇ Associates Limited dated August 2, 2023, as may be supplemented, updated and/or revised: • P.O.T.L. #11 – 13, 25 – 31 DRAFT Purchasers/Tenants are hereby advised that sound levels due to increasing road and rail traffic may occasionally interfere with some activities of the dwelling occupants as the sound levels exceed the Municipality’s and the Ministry of the Environment, Conservation & Park’s noise criteria (Appendix A – Figure 2, and Appendix C). • P.O.T.L. #11 – 31 This dwelling unit has been fitted with a forced air heating system and the ducting, etc. was sized to accommodate central air conditioning. Installation of central air conditioning by the occupant will allow windows and exterior doors to remain closed, thereby ensuring that the indoor sound levels are within the Municipality’s and the Ministry of the Environment, Conservation and Parks’ noise criteria. (Note: The location and installation of the outdoor air conditioning device should be done so as to comply with noise criteria of MECP Publication NPC216, Residential Air Conditioning Devices, and thus minimize the noise impacts both on and in the immediate vicinity of the subject property.) NOISE REPORT. 67.1 The Buyer acknowledges:
(a) having read the Noise Report;
(b) that the Buyer is bound by the conditions of the Noise Report;
(c) that the Land may be subject to a designated building envelope as set out in the Noise Report;
(d) and agrees that any building envelope on the Noise Report may change and the Buyer will not Object; and
(e) the Buyer may be required to obtain an independent assessment of the Land prior to construction of a dwelling on the Land.
67.2 The Buyer must not Object to the Noise Report.
