Common use of No Suits Clause in Contracts

No Suits. There are no suits, arbitrations or other proceedings pending or threatened against Each Seller and Existing Lessor before any court or administrative agency against or affecting Seller which, if adversely determined, would have a material adverse effect on the business, assets or condition (financial or otherwise) of Seller or its ability to perform under the Sale Documents to which it is a party.

No Suits. There are no suits, arbitrations or other proceedings pending or threatened against Each Seller and Existing Buyer, any Buyer’s Nominee or any New Lessor before any court or administrative agency against or affecting Seller Buyer which, if adversely determined, would have a material adverse effect on the business, assets or condition (financial or otherwise) of Seller Buyer or its ability to perform under the Sale Documents to which it is a party.

There are no suits, arbitrations or other proceedings pending or threatened against Each Seller and Existing Lessor SELLER before any court or administrative agency against or affecting Seller SELLER which, if adversely determined, would have a material adverse effect on the business, assets or condition (financial or otherwise) of Seller or its SELLER’s ability to perform under the Sale Operative Documents to which it is a party(or any of them).

There are no suits, arbitrations or other proceedings pending or threatened against Each Seller and Existing Lessor SELLER before any court or administrative agency against or affecting Seller SELLER which, if adversely determined, would have a material adverse effect on the business, assets or condition (financial or otherwise) of Seller SELLER or its ability to perform under the this Sale Documents to which it is a partyAgreement.
