Common use of No Segregation of Moneys Clause in Contracts

No Segregation of Moneys. No moneys paid to or retained by the Agent pursuant to any provision hereof and not then required to be distributed to any Lender or the Borrower as provided in the Security Agreement need be segregated in any manner except to the extent required by law, and may, except as aforesaid, be deposited under such general conditions as may be prescribed by law, and the Agent shall not be liable for any interest thereon; provided that any payments received or applied hereunder or under the Security Agreement by the Agent shall be accounted for by the Agent to the same extent as the Agent has received prior written notice (which may include telecopy advice of the source and amount of funds being wired to it) so that any portion thereof paid or applied pursuant hereto shall be identifiable as to the source thereof.
