Common use of No Rights to Enforce Clause in Contracts

No Rights to Enforce. A Covered Entity may exercise the rights set forth in regard to the Covered Entity in this Agreement, including the right to assume general management and overall direction and control of all Response Activities under this Agreement, but does not have or obtain any rights to enforce directly by arbitration or legal or administrative proceedings any provisions of this Agreement, including any obligations of MSRC under this Agreement. The COMPANY retains all rights to enforce this Agreement in accordance with its terms.
