No public statement. Except as necessary in the course of litigation defense as set forth in section (e) above, upon court approval of a plan of dissolution, neither TI nor any of its employees or agents acting in their official capacity on behalf of TI will issue any statements, press releases, or other public statement concerning tobacco.

The Executive shall not at any time during any period when he is required to cease the performance of his duties under Clause 5.4 or after the Termination Date make any public statement in relation to the Company or any Group Company or any of their officers or employees. The Executive shall not without the Company’s consent after the termination of the Employment represent himself as being employed by or connected with the Company or any Group Company.

Except as permitted in this Agreement, Employee also will not use in any public written or oral statement, news release, or other public announcement or publication the indicia or name of D&B or any of its customers, personnel, or agents, without first obtaining the written consent of Chief Executive Officer or Chief Legal Officer. “Public written or oral statement” does not include any documents or statements Employee will create or make in the normal course of his job search or his future employment to the extent such documents and statements refer solely to Employee’s position at and dates of employment with D&B.
