No Indulgence. If one party chooses not to enforce any part of this XXXX, that does not mean that the party cannot enforce that part at a later time. If any part of the XXXX is found to be unenforceable, the rest will still be enforceable.

No latitude, extension of time or other indulgence which may be given or allowed by the Employer to the Employee in respect of the performance of any obligation in terms of the contract, and no delay or forbearance in the enforcement of any right of any party arising from the contract, and no single or partial exercise of any right by any party under the contract, shall in any circumstances be construed to be an implied consent or election by such party or operate as a waiver or a novation of or otherwise affect any of the party’s rights in terms of arising from the contract or estop or preclude any such party from enforcing at any time and without notice, strict and punctual compliance with each and every provision or term thereof.

No Indulgence. No waiver by a party of any breach, failure or default in performance by the other party, and no failure, refusal or neglect by a party to exercise any right hereunder or to insist upon strict compliance with or performance of the other party's obligations under THIS AGREEMENT, shall constitute a waiver of the provisions of THIS AGREEMENT and a party may at any time require strict compliance with the provisions of THIS AGREEMENT.
No Indulgence. No indulgence that the parties may grant to each other with regard to the compliance with any of the obligations in terms of this contract prejudices or constitutes a waiver of any parties’ rights in terms of this contract.
No Indulgence. No time, indulgence or forbearance granted by the Manager or any delay or omission on the Manager’s part in exercising any of its rights or powers hereunder shall operate to impair, or preclude further exercise of, such right or power or be construed as a waiver thereof. The rights, powers and remedies of the Manager herein provided are cumulative and non-exclusive of any other rights, powers or remedies available to the Manager.
