No failure by the Collateral Agent or any Secured Party to exercise, and no delay in exercising and no course of dealing with respect to, any right or remedy under any Security Document shall operate as a waiver thereof; nor shall any single or partial exercise by the Collateral Agent or any Secured Party of any right or remedy under any Loan Noteholder Document preclude any other or further exercise thereof or the exercise of any other right or remedy. The rights and remedies specified in the Loan Noteholder Documents are cumulative and are not exclusive of any other rights or remedies provided by law.
