Network Upgrades and Distribution Upgrades. Unless the Parties have agreed otherwise agreed pursuant to Section 11.2 of Transmission Provider’s GIP and Article 5 of this GIA, Transmission Provider or Transmission Owner shall design, procure, construct, install, and own the Network Upgrades and Distribution Upgrades described in Appendix A (Interconnection Facilities, Network Upgrades and Distribution Upgrades). The Interconnection Customer shall be responsible for all costs related to Distribution Upgrades. Unless Transmission Provider or Transmission Owner elects to fund the capital for the Network Upgrades, they shall be solely funded by Interconnection Customer.
