NES MINIMUM STANDARDS. 5.8.1 The National Employment Standards (NES) apply at all times on and from 1 January 2010 to any Employees covered by this Agreement. 5.8.2 Where the NES provides, or is varied to provide, a benefit or condition or entitlement more favorable in a particular respect than that contained in this Agreement, the benefit or condition or entitlement contained in this Agreement shall be overridden to the extent of any less favorable inconsistency with the NES.
