Mutual References Clause Samples
The Mutual References clause establishes that any references made within the agreement to specific sections, terms, or provisions are intended to apply equally to both parties involved. In practice, this means that if a right, obligation, or condition is mentioned in relation to one party, it is also applicable to the other party unless explicitly stated otherwise. This clause ensures balanced interpretation and prevents ambiguity, promoting fairness by clarifying that contractual terms are reciprocal unless the agreement specifies a different arrangement.
Mutual References. Each party may identify the other in its marketing and advertising materials, and such materials may include relevant quotes from either InterWorld or Licensee; provided that any such materials have been approved in advance by the other party prior to use, which approval shall not be unreasonably withheld or delayed.
Mutual References. 5.1 The use of the logo of the other partner for any purpose – apart from featuring the cooperation on the general websites – shall be subject to prior approval by the partner.
5.2 Any public announcements through press releases, media advisories or other similar means regarding this MoU or joint initiatives under this MoU shall require the prior written approval of the partner.
