Common use of Multiple Contract Awards; Non-Exclusivity Clause in Contracts

Multiple Contract Awards; Non-Exclusivity. In accordance with TEX. GOV’T. CODE §2269.406, Region III ESC/PCA reserves the right to award multiple contracts under the solicitation, including multiple contracts for each product/service category. Product/Service categories are established at the sole discretion of Region III ESC/PCA. Nothing in this Contract may be construed to imply that Vendor has the exclusive right to provide products and/or services to PCA Members. During the Term of this Contract, PCA Members reserve the right to use all available resources to procure other products and/or services as needed and doing so will not violate any rights of Vendor.
