Common use of Mortgagees Clause in Contracts

Mortgagees. 10.1 The obligations contained in this Deed will not be enforceable against any mortgagee or chargee from time to time of the whole or any part of the Site or Sites unless it takes possession of the Site or Sites (through the exercise of its powers under the relevant charge) in which case it will be bound by the obligations applicable to the Site or Sites or (as the case may be) part of the Site or Sites to which the relevant mortgage or charge applies
