MONITORING PROGRAMS Clause Samples

The Monitoring Programs clause establishes requirements for ongoing oversight and evaluation of certain activities, processes, or compliance obligations within an agreement. Typically, it outlines the methods and frequency of monitoring, such as regular inspections, audits, or reporting, and may specify the responsibilities of each party in conducting or participating in these programs. By setting clear expectations for monitoring, this clause helps ensure that standards are maintained and that any issues are identified and addressed promptly, thereby reducing risk and promoting accountability.
MONITORING PROGRAMS. Title 27 requires that the Dischargers maintain a groundwater-monitoring program designed to detect the presence of waste constituents in groundwater outside of the waste management unit (WMU). The required monitoring is included in the Discharge Monitoring Program (Attachment A) and consists of a list of constituents of concern (COCs), sampling frequency, approved analytical methods, reporting requirements, the point of compliance, and an approved evaluation method to determine compliance consistent with Title 27.

MONITORING PROGRAMS. Effective monitoring of the progress of programs and the individual projects is essential to determine whether program objectives are being achieved, funds are being spent for their intended purpose, and problems are detected early during implementation of the Agreement, thus providing a basis for refinement. The Agreement requires that the programs and the individual projects be properly managed through the preparation of annual work plans, financial and management information reports, the conduct of regular meetings, a review of the Agreement strategy, programming and budget, and the inspection and audit of projects. Our review of this area indicated the following:
