Common use of Monitoring of Subservicers Clause in Contracts

Monitoring of Subservicers. (a) The Servicer shall perform all of its servicing responsibilities hereunder or may cause a subservicer to perform any such servicing responsibilities on its behalf, but the use by the Servicer of a subservicer shall not release the Servicer from any of its obligations hereunder and the Servicer shall remain responsible hereunder for all acts and omissions of each subservicer as fully as if such acts and omissions were those of the Servicer. Any such subservicer must be a Fannie Mae approved seller/servicer or a Freddie Mac seller/servicer in good standing and no evxxx xhaxx have occurred, including but not xxxxxed to, a change in insurance coverage, which would make it unable to comply with the eligibility requirements for lenders imposed by Fannie Mae or for seller/servicers by Freddie Mac, or which would require notification to Fxxxxx Mxx or Freddie Mac. The Servicer xxxxx pay all fees and expenses of each subservicer frox xxx owx xunds, xxx x subservicer's fee shall not exceed the Servicing Fee.
