Monitoring Framework Agreement Performance. 11.1 The Parties shall manage this Framework Agreement and provide the Management Information in accordance with Framework Schedule 7 (Framework Management). 11.2 The Supplier grants the Authority a non-exclusive, transferable, perpetual, irrevocable, royalty free licence to: (a) use and to share with any Central Government Body, Contracting Body and Relevant Person; and/or (b) publish (subject to any information that is exempt from disclosure in accordance with the provisions of FOIA being redacted), any Management Information and any information provided pursuant to Clause 11.5 for the Authority's operational activities including administering this Framework Agreement and/or all Call Off Contracts, monitoring public sector expenditure, identifying savings or potential savings and planning future procurement activity. 11.3 The Authority has established a central monitoring, reporting, evaluation and learning system to provide reporting on expenditure and outcomes achieved across the Prosperity Fund and delivery of tailored evaluations to determine of the quality and effectiveness of the Prosperity Fund. These evaluations will be used to inform the Authority about whether the operation of the Prosperity Fund is meeting the required objectives (the "MREL System"). 11.4 As part of the MREL System, the Authority has appointed: (a) a third party supplier who will be responsible for monitoring and reporting on the expenditure and outcomes achieved across the Prosperity Fund (the "MR Provider"); and (b) a third party supplier who will be responsible the evaluating such expenditure and outcomes and identifying learnings and improvements for future projects under the Prosperity Fund (the "EL Provider"), together (the "MREL Providers"). 11.5 The Supplier shall (in respect of this Framework Agreement and each Call Off Contract): (a) in a timely manner, fully co-operate and engage constructively with the MREL Providers (including any sub-contractors of the MREL Providers) to ensure the success of the MREL System. Such co-operation and engagement shall include: (i) complying with any guidelines issued by the MR ▇▇▇▇▇▇▇▇; (ii) engaging with the MR ▇▇▇▇▇▇▇▇ to identify the reporting and management information that will apply to a Call Off Contract; and (iii) engaging with the EL Provider during evaluations to ensure that it is conducted in a timely and effective manner in accordance with the evaluation methodology and plan; (b) provide the MREL System reporting and mana...

  • Monitoring of Contract Performance The Contractor shall comply with the monitoring arrangements set out in the Monitoring Requirements Schedule including, but not limited to, providing such data and information as the Contractor may be required to produce under the Contract.

  • Monitoring of Performance Vendor shall continuously monitor and record its performance to ensure that all of Vendor's responsibilities and obligations hereunder are being met and fulfilled. Citizens may conduct programmatic and other administrative contract monitoring during the term of this Agreement. The purpose of this monitoring is to ensure that all of Vendor's responsibilities and obligations are being met and fulfilled. Such monitoring may include on-site visits, report reviews, invoice reviews, compliance reviews, and a review of any other areas reasonably necessary.   • PERFORMANCE MANAGEMENT SYSTEM 5.1 The Employee agrees to participate in the performance management system that the Employer adopted for the employees of the Employer; 5.2 The Employee accepts that the purpose of the performance management system will be to provide a comprehensive system with specific performance standards to assist the employees and service providers to perform to the standards required; 5.3 The Employer must consult the Employee about the specific performance standards and targets that will be included in the performance management system applicable to the Employee; 5.4 The Employee undertakes to actively focus on the promotion and implementation of the key performance indicators (including special projects relevant to the employee’s responsibilities) within the local government framework; 5.5 The criteria upon which the performance of the Employee shall be assessed shall consist of two components, Operational Performance and Competencies both of which shall be contained in the Performance Agreement; 5.6 The Employee’s assessment will be based on his performance in terms of the outputs/outcomes (performance indicators) identified as per attached Performance Plan, which are linked to the KPAs, and will constitute 80% of the overall assessment result as per the weightings agreed to between the Employer and Employee; 5.7 The Competencies will make up the other 20% of the Employee’s assessment score.   • Software Performance HP warrants that its branded software products will conform materially to their specifications and be free of malware at the time of delivery. HP warranties for software products will begin on the date of delivery and unless otherwise specified in Supporting Material, will last for ninety (90) days. HP does not warrant that the operation of software products will be uninterrupted or error-free or that software products will operate in hardware and software combinations other than as authorized by HP in Supporting Material.

  • Continuing Performance In the event of a dispute, the Owner and the Developer agree to continue their respective performance hereunder to the extent feasible in light of the dispute, including paying ▇▇▇▇▇▇▇▇, and such continuation of efforts and payment of ▇▇▇▇▇▇▇▇ shall not be construed as a waiver of any legal right.
