Common use of Mitigation Requirements Clause in Contracts

Mitigation Requirements. Design-Builder shall perform all environmental mitigation measures for the Project. The phrase “environmental mitigation measures" includes all requirements of the Environmental Approvals and similar Governmental Approvals, regardless of whether these requirements fall within a strict definition of the phrase. The Contract Price includes compensation for Design-Builder’s performance of all mitigation measures and for performance of all mitigation measures arising from New Environmental Approvals that Section 6.4.2 designates as Design-Builder’s responsibility, and the cost of all activities to be performed by Design-Builder as described in Section 10 of the Technical Provisions.
