Common use of Mitigation of Delay Clause in Contracts

Mitigation of Delay. Design-Builder shall take all reasonable actions to minimize the delay caused by any of the above factors, and shall notify Owner in writing with a copy to the Design Professional of any event allowing for excuse or delay not later than seven days after the Design-Builder first becomes aware of the event, or should have become aware, of the event; otherwise Design-Builder will be deemed to have waived the excuse or delay.
