Miscellaneous Section. 1. This Agreement shall be deemed drafted and prepared equally jointly regardless of which Party prepared or submitted the Agreement to the other. Section 2. Except for the Parties hereto and their successors and assigns, no person, including without limitation any owner of a royalty or overriding royalty interest, shall have any rights as a third party beneficiary or otherwise under this Agreement.

Miscellaneous Section. The miscellaneous section may include data related to the employee not otherwise listed in above sections.

Miscellaneous Section. 1. As supplemented and amended by this One Hundred and Twenty-Ninth Supplemental Indenture, the Original Indenture and all indentures supplemental thereto are in all respects ratified and confirmed and the Original Indenture and the aforesaid supplemental indentures and this One Hundred and Twenty-Ninth Supplemental Indenture shall be read, taken and construed as one and the same instrument.

The system will check the project application you selected.  The application shows no errors it’s ready for review and submission by the Authorized Official.  If the application has errors, click the red circle ‘Error’ icon to view the errors.  To correct the errors, click on the project application name (hyperlink) to access the application and begin fixing the errors.  After making the corrections, re-validate the application.  Repeat these steps until the application is error free.  Navigate to: Grantee -> Grant Application -> Grant Application Preview and click the ‘Go’ button.  The system displays the ‘Grant Application Preview’ screen.  Only the Authorized Official can submit the applications. To submit the application, the Authorized Official completes the following steps:  *Program: Select a Grant Program, using the 'Lookup' icon.  Agency: System pre-populates.  Additional search criteria, allows you to narrow down your selection.  Project: Select the program element using the 'Lookup' icon.  Stages: Select the Stage of the program, using the 'Lookup' icon.  Status: Select the status, after selecting the Stage, using the 'Lookup' icon.  Click the ‘Go’ button. Miscellaneous Section. A. This Agreement shall supersede any rules, regulations or practices of the Board which shall be contrary to or inconsistent with its terms. It shall likewise supersede any contrary or inconsistent terms contained in any individual teacher contracts heretofore in effect. All future individual teacher contracts shall be made expressly subject to the terms of this Agreement. The provisions of this Agreement shall be incorporated into and be considered part of the established policies of the Board. B. Copies of this Agreement shall be printed at the expense of the Board and presented to all teachers now employed or hereafter employed by the Board. The Association will be presented five additional copies. C. It is understood by the parties that the establishment of new positions in the district and modifications to working conditions shall be subject to negotiation between the parties.

The Association will be presented five additional copies. One copy of the School Board policies and procedures pertaining to Teacher Evaluations, Teacher Layoff and Recall, Teacher Placement and Employee Discipline shall be provided in writing to the Association. If any or all of those policies and/or procedures are changed or altered the Board will provide within five work days a written copy of such changes. The Board agrees to send notices of all public Board regular and committee meetings to the Association president. C. It is understood by the parties that the establishment of new positions in the district and modifications to working conditions shall be subject to negotiation between the parties.

Miscellaneous Section. A new Section "SECTION 27. MISCELLANEOUS" is hereby added to the JVA.

Miscellaneous Section. H(2), entitled “Entire Agreement”, shall be revised to read as follows: “In the event of any inconsistency between the provisions in the body of this Agreement and the attachments, the provisions in the body of this Agreement take precedence, followed by the Standard Provisions for City Contracts (Rev. 9/11) (Appendix A).’ Except as amended by this First Amendment, all other terms and conditions of Contract C-115265, shall remain in full force and effect.

Miscellaneous Section. The miscellaneous section may include data related to the employee not otherwise listed in above sections, such as criminal background checks, and other files required by the Michigan State Police and FBI, etc. All medical information, including health certificates and worker’s compensation records, shall be kept in files separate from employee personnel records.
