Miscellaneous Section. A. This Agreement shall supersede any rules, regulations or practices of the Board which shall be contrary to or inconsistent with its terms unless such rules, regulations and practices are enacted by the District to become in compliance with State and Federal Education Laws. It shall likewise supersede any contrary or inconsistent terms contained in any individual teacher contracts heretofore in effect. All future individual teacher contracts shall be made expressly subject to the present terms of this Agreement that are in compliance with the above State and Federal Laws. The provisions of this Agreement shall be incorporated into and be considered part of the established policies of the Board. B. Copies of this Agreement shall be printed at the expense of the Board and presented to all teachers now employed or hereafter employed by the Board. The Association will be presented five additional copies. C. It is understood by the parties that the establishment of new positions in the district and modifications to working conditions shall be subject to negotiation between the parties.
Miscellaneous Section. 1. This Agreement shall be deemed drafted and prepared equally jointly regardless of which Party prepared or submitted the Agreement to the other. Section 2. Except for the Parties hereto and their successors and assigns, no person, including without limitation any owner of a royalty or overriding royalty interest, shall have any rights as a third party beneficiary or otherwise under this Agreement.

The Board agrees to send notices of all public Board regular and committee meetings to the Association president. C. Miscellaneous Section. H(2), entitled “Entire Agreement”, shall be revised to read as follows: “In the event of any inconsistency between the provisions in the body of this Agreement and the attachments, the provisions in the body of this Agreement take precedence, followed by the Standard Provisions for City Contracts (Rev. 9/11) (Appendix A).’ Except as amended by this First Amendment, all other terms and conditions of Contract C-115265, shall remain in full force and effect.
