Common use of Misapplication of Funds Clause in Contracts

Misapplication of Funds. (i) Distribute any revenue from the Property or any Proceeds in violation of the provisions of this Agreement, (ii) fail to remit amounts to the Mezzanine Account, as required by Section 3.1 or (iii) the Pledge, misappropriate any security deposit or portion thereof or misapply the proceeds of the Loan; or

(i) Distribute any revenue from the Property or any Proceeds in violation of the provisions of this Agreement, (ii) fail to remit amounts to the Fourth Mezzanine Account, as required by Section 3.1 3.1, or (iii) the Pledge, misappropriate any security deposit or portion thereof or misapply apply the proceeds of the LoanLoan in violation of Section 2.1.4; or
