Common use of Minimum Load Capability Clause in Contracts

Minimum Load Capability. The Facility shall allow for a net minimum load capability under remote dispatch of seven (7) MW at Company’s sole discretion as necessary due to system constraints, system balancing and frequency control. The output of the Facility may be directed to operate at less than the net minimum load capability of seven (7) MW by instruction from the Company System Operator under disturbances or other unusual operating conditions which could be mitigated or addressed by the reduction of the Facility in the judgment of the Company System Operator, such as, but not limited to: excess energy conditions due to abnormal operating conditions such as could be caused by unexpected loss of load, system over-frequency, transmission equipment overload or risk of transmission overloads due to contingencies, and high voltages in the vicinity of the interconnection.

The output of the Facility may be directed to operate at less than the net minimum load capability of seven twenty-two (722) MW under remote dispatch by instruction from the Company System Operator to the extent that the Existing Facility is producing less than twenty-two (22) MW or by the System Operator under disturbances or other unusual operating conditions which could be mitigated or addressed by the reduction of the Facility in the judgment of the Company System Operator, such as, but not limited to: excess energy conditions due to abnormal operating conditions such as could be caused by unexpected loss of load, system over-frequency, transmission equipment overload or risk of transmission overloads due to contingencies, and high voltages in the vicinity of the interconnection.
