Mediator's Costs to be Borne Equally the mediator's costs are to be paid equally by the parties and the parties will be jointly and severally liable to the mediator for such costs. This clause 21.4(h) confers a benefit or right on the mediator and is intended to be enforceable by the mediator under the Contracts (Privity) Act 1982; and
