Maximum Class Size For Special Programs. 8.3.1 Special education teachers, speech therapists, librarians, nurses, and counselors, when such positions are authorized by District management, shall be assigned in addition to regular classroom personnel. 8.3.2 Prior to the implementation of the class loads for the programs listed in Sections 8.3.3 and 8.3.4, the District will notify the Association President of the proposed loadings in order that the Association may properly advise the effected bargaining unit members. 8.3.3 Class sizes for band, instrumental music, choral music, and other performing groups may fluctuate according to the needs of the individual school and the District. In general, class loading for these programs will be determined by the District management in consultation with the appropriate bargaining unit members. 8.3.4 Maximum class sizes for special education programs and case loads for specialists shall be determined by state guidelines. When such do not exist, or when the actual loading factors will be less than that established by the state, then the final class sizes or specialists’ loading factors shall be determined by District management in consultation with the appropriate bargaining unit members. 8.3.5 As delineated by the California Education Code, instructional minutes, individual services, and Special Day Class placement are determined by the Individual Education Plan (IEP).
