Common use of Massachusetts Business Trust Clause in Contracts

Massachusetts Business Trust. With respect to any Fund, which is a party to this Agreement and which is organized as a business trust under the laws of the Commonwealth of Massachusetts, the term Fund means and refers to the trustees serving under the applicable incorporation document. It is expressly agreed that the obligations of any such Fund under this Agreement will not be binding on any of the trustees, directors, Portfolio shareholders, nominees, officers, agents or employees of such Fund personally, but bind only the property of such Fund's Portfolios.

Massachusetts Business Trust. With respect to any Fund, the Portfolio which is a party to this Agreement and which is organized as a Massachusetts business trust under the laws of the Commonwealth of Massachusettstrust, the term Fund means and refers to the trustees serving under the applicable incorporation documenttrust agreement. It is expressly agreed that the obligations of any such Fund the Trust under this Agreement will not be binding on any of the trustees, directors, Portfolio shareholders, nominees, officers, agents or employees of such Fund the Trust personally, but bind only the property of such Fund's Portfoliostrust property.
