Mandatory Procedure Clause Samples

A Mandatory Procedure clause establishes a required process or set of steps that parties must follow in specific situations outlined in the contract. This may include procedures for dispute resolution, notification requirements, or approval processes that must be adhered to before certain actions can be taken. By clearly defining these procedures, the clause ensures consistency, reduces ambiguity, and helps prevent misunderstandings or disputes about how particular matters should be handled under the agreement.
Mandatory Procedure. Employees assigned to a FCNR shall be placed on the same continuous rotating mandatory list with other employees working normal rotation and non-rotating post/job assignments. When a female is required for the on-coming shift and there is not enough females assigned to the next shift and no female employee volunteers, the next female on the top of the continuous rotating mandatory list shall be mandated to work. This may include skipping males that are ahead of the female employee.
Mandatory Procedure. This administrative procedure and the time limits set forth herein are mandatory. Failure to comply with these mandatory procedures shall constitute a waiver of any right to pursue the bid protest, including filing a Government Code claim or any legal proceedings or actions.
Mandatory Procedure. The procedures specified in this Section 16.16 are intended to be a mandatory first step in seeking to resolve Disputes between the parties arising out of or relating to this Agreement; provided, however, that any party, without prejudice to the above procedures, may file a complaint in a court of competent jurisdiction for statute of limitations or venue reasons, or seek provisional, interim, equitable or conservatory relief, including a temporary restraining order, preliminary injunction or action to specifically enforce obligations under this ACTIVE/107611452.20 Agreement, if in its reasonable judgment such action is necessary to avoid irreparable damage or to preserve the status quo. Despite such action, the parties will continue to participate in good faith in following the Dispute resolution procedures specified in this Section 16.16.
