Mandatory Dispute Resolution. In the event any dispute arises between Seller and Purchaser prior to Closing, the parties acknowledge and agree to mediate the dispute with JAMS ADR in Denver, Colorado. If the dispute is not resolved to both parties’ mutual satisfaction within thirty (30) days after written notice by one party to the other of the dispute, the parties may avail themselves of any and all remedies at law or in equity. IMPORTANT NOTICE: In the event any dispute arises between Seller and Purchaser subsequent to Closing, Seller and Purchaser agree to be bound by the Alternative Dispute Resolution Procedures set forth in the Residence Declaration accepted by Purchaser prior to Purchaser’s execution of this Agreement. (Seller is referred to as “Declarant” and Purchaser as an “Owner” in the Residence Declaration). The Residence Declaration shall govern all disputes between Seller and Purchaser in the manner set forth in the Residence Declaration, which Purchaser acknowledges and agrees contains, among other matters, the requirement of binding arbitration.
