Common use of Malt Clause in Contracts

Malt. The aggregate quantity of goods entered under the provisions listed in subparagraph (c) shall be duty-free in any year specified below, and shall not exceed the quantities specified below for Canada in each such year: Year Quantity (Metric Tonnes) 1 13,000 2 14,200 3 15,400 4 16,600 5 17,800 6 19,000 7 20,200 8 21,400 9 22,600 10 23,800 Year Quantity (Metric Tonnes) These TRQs shall be administered by the Korea Agro-Fisheries Trade Corporation, or its successor. The Corporation shall allocate licenses upon written application on a first-come, first-served basis between the first business day and the last business day of the first month of each year. If the total amount of originating goods applied for during the first month of the year exceeds the total amount of originating goods available within the TRQ, licenses shall be allocated on a prorated basis. If the total amount of originating goods applied for during the first month of the year is less than the total quantity available within the TRQ, licenses shall continue to be available throughout the year. Each license allocated by the Corporation is valid for a period of 90 days from the date of allocation, and unused licenses shall be surrendered to the Corporation upon the expiration of the 90-day period and reallocated to applicants on a first-come, first-served basis within 45 days of the date of surrender.
