Common use of Made Available Clause in Contracts

Made Available. The phrases “furnished,” “provided,” “delivered” or “made available” or words of similar import when used in Article III with respect to documents or other information means that such documents or information have been physically or electronically delivered to the relevant Party prior to the date of this Agreement by being (i) posted to the virtual data room managed by the Company in connection with the Merger or (ii) filed with or furnished to the SEC and available in its Electronic Data Gathering, Analysis and Retrieval (▇▇▇▇▇) database.

Made Available. The phrases “furnished,” “provided,” “delivered” or “made available” or words of similar import when used in Article III with respect to documents or other information means that such documents or information have been physically or electronically delivered to the relevant Party at least two (2) Business Days prior to the date of this Agreement Agreement, including by being (i) posted to the virtual data room managed by Seller and the Company in connection with the Merger Stock Purchase or (ii) filed with or furnished to the SEC and available in its Electronic Data Gathering, Analysis and Retrieval database (“▇▇▇▇▇) database”).

Made Available. The phrases “furnished,” “provided,” “delivered” or “made available” or words of similar import when used in Article III with respect to documents or other information means that such documents or information have been physically or electronically delivered to the relevant Party or its Representatives prior to the date of this Agreement Agreement, including by being (i) posted to the virtual data room managed by the Company in connection with the Merger or (ii) filed with or furnished to the SEC and available in its Electronic Data Gathering, Analysis and Retrieval (▇▇▇▇▇) database.

Made Available. The phrases “furnished,” “provided,” “delivered” or “made available” or words of similar import when used in Article III with respect to documents or other information means that such documents or information have been physically or electronically delivered to the relevant Party prior to the date of this Agreement Agreement, including by being (i) posted to the virtual data room managed by the Company in connection with the Merger at least two hours prior to the execution of this Agreement or (ii) filed with or furnished to the SEC and available in its Electronic Data Gathering, Analysis and Retrieval (on ▇▇▇▇▇) database▇ at least one day prior to the date of this Agreement.
