Common use of LOST, STOLEN, MUTILATED OR DESTROYED WARRANT Clause in Contracts

LOST, STOLEN, MUTILATED OR DESTROYED WARRANT. Upon receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Warrant and, in the case of any such loss, theft or destruction, upon receipt of indemnity or security reasonably satisfactory to the Company or, in the case of any such mutilation, upon surrender and cancellation of this Warrant, the Company shall issue a new Warrant, in lieu of the Warrant so lost, stolen, destroyed or mutilated, of like denomination and tenor as this Warrant so lost, stolen, mutilated or destroyed. Any such new Warrant shall constitute an original contractual obligation of the Company, whether or not the allegedly lost, stolen, mutilated or destroyed Warrant shall be at any time enforceable by anyone.

LOST, STOLEN, MUTILATED OR DESTROYED WARRANT. Upon receipt of evidence reasonably satisfactory to the Trust and the Company of the loss, theft, destruction or mutilation of this Warrant and, in the case of any such loss, theft or destruction, upon receipt of indemnity or security reasonably satisfactory to the Trust and the Company or, in the case of any such mutilation, upon surrender and cancellation of this Warrant, the Trust and the Company shall issue a new Warrant, in lieu of the Warrant so lost, stolen, destroyed or mutilated, of like denomination and tenor as this Warrant so lost, stolen, mutilated or destroyed. Any such new Warrant shall constitute an original contractual obligation of the Trust and the Company, whether or not the allegedly lost, stolen, mutilated or destroyed Warrant shall be at any time enforceable by anyone.

LOST, STOLEN, MUTILATED OR DESTROYED WARRANT. Upon receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Warrant any Warrant, and, if requested in the case of any such loss, theft or destruction, upon receipt delivery of indemnity or security an affidavit of loss reasonably satisfactory to the Company Company, or, in the case of any such mutilation, upon surrender and cancellation of this Warrant, the Company shall will issue a new Warrant, in lieu of the Warrant so lost, stolen, destroyed or mutilated, warrant of like denomination and tenor as this the Warrant so lost, stolen, mutilated or destroyed. Any such new , which shall, in place of the Warrant shall constitute so lost, stolen, mutilated or destroyed, be deemed an original contractual obligation of the Company, whether or not the allegedly lost, stolen, mutilated or destroyed Warrant shall be at any time enforceable by anyone.

LOST, STOLEN, MUTILATED OR DESTROYED WARRANT. Upon receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of this Warrant and, in the case of any such loss, theft or destruction, upon receipt delivery of an indemnity or security agreement reasonably satisfactory in form and amount to the Company or, in the case of any such mutilation, upon surrender and cancellation of this such Warrant, the Company shall issue a new WarrantCompany, at its expense, will execute and deliver to the Holder, in lieu of the thereof, a new Warrant so lost, stolen, destroyed or mutilated, of like denomination date and tenor as this Warrant so lost, stolen, mutilated or destroyedtenor. Any such new Warrant shall constitute an original contractual obligation of the Company, whether or not the allegedly lost, stolen, mutilated or destroyed Warrant shall be at any time enforceable by anyone.
