Common use of Loss, Theft, Destruction or Mutilation of Note Clause in Contracts

Loss, Theft, Destruction or Mutilation of Note. Upon notice by Payee to Maker of the loss, theft, destruction or mutilation of this Note, and upon surrender and cancellation of this Note, if mutilated, Maker, as its expense, will make and deliver a new note of like tenor, in lieu of this Note, subject to receipt of an Affidavit of Loss by the Company and reasonably satisfactory indemnification (as determined by the Company).

Loss, Theft, Destruction or Mutilation of Note. Upon receipt of notice by Payee to Maker of the loss, theft, destruction or mutilation of this Note, and and, in the case of any such loss, theft or destruction, upon surrender and cancellation receipt of an affidavit of loss from Payee to Maker, Maker shall issue a new Note to Payee with identical terms as this Note in replacement of this Note, if mutilated, Maker, as its expense, will make and deliver a new note of like tenor, in lieu of this Note, subject to receipt of an Affidavit of Loss by the Company and reasonably satisfactory indemnification (as determined by the Company).

Upon notice by Payee to Maker In the case of the any loss, thefttheft or destruction of this Note, destruction or upon receipt of an affidavit of loss from the holder thereof, or, in the case of mutilation of this Note, and upon surrender and cancellation of this Note, if mutilated, Maker, as its expense, the Company will make and deliver a new note of like tenordeliver, in lieu of this Note, subject to receipt a substitute Note of an Affidavit like tenor and unpaid principal amount and dated as of Loss by the Company and reasonably satisfactory indemnification (as determined by the Company)date hereof.

Upon notice by Payee the Noteholder to Maker the Issuer of the loss, theft, destruction or mutilation of this Note, and of indemnity or security reasonably satisfactory to the Issuer, and upon reimbursement to the Issuer of all reasonable expenses incidental thereto, and upon surrender and cancellation of this Note, if mutilated, Maker, as its expense, the Issuer will make and deliver a new note Note of like tenor, in lieu of this Note, subject to receipt of an Affidavit of Loss by the Company and reasonably satisfactory indemnification (as determined by the Company).
