Loan Agreement Amendment. The Loan Agreement is, effective as of the Amendment No. 1 Effective Date (as defined below), hereby amended as follows:

Loan Agreement Amendment. Section 8.08(d) of the Loan Agreement is hereby amended in its entirety to read as follows:
Loan Agreement Amendment. The Lender shall have received that certain Second Amendment to Loan Agreement, dated as of the date hereof, among Borrower, each of the other Loan Parties party thereto and Xxxxxx, and all conditions precedent set forth in Section 2 therein shall have been satisfied.
Loan Agreement Amendment. The Loan Agreement is hereby amended by adding a new Article IIIA to read in its entirety as follows:
Loan Agreement Amendment. Section 5.02 of the Loan Agreement shall apply to the Construction Loan Advances only and the Loan Agreement is hereby further amended by adding a new Section 5.03 to read in its entirety as follows:
