Common use of Litigation Cooperation Clause in Contracts

Litigation Cooperation. From the date hereof and continuing through the termination of this Agreement, make available to Agent, without expense to Agent, Borrower and its officers, employees and agents and Borrower’s Books, to the extent that Agent may deem them reasonably necessary to prosecute or defend any third-party suit or proceeding instituted by or against Agent with respect to any Collateral or relating to Borrower.

Litigation Cooperation. From the date hereof and continuing through the termination of this Agreement, make available to Agent, without expense to AgentAgent or any Lender, Borrower and its officers, employees and agents and Borrower’s Booksbooks and records, to the extent that Agent and/or the Lenders may deem them reasonably necessary to prosecute or defend any third-party suit or proceeding instituted by or against Agent and/or any Lender with respect to any Collateral or relating to Borrower.

From the date hereof and continuing through the termination of this Agreement, upon the reasonable request of Agent or any Lender, make available to Agent, without expense to AgentAgent or any Lender, Borrower and its officers, employees and agents and Borrower’s Booksbooks and records, to the extent that Agent and/or the Lenders may deem them reasonably necessary to prosecute or defend any third-party suit or proceeding instituted by or against Agent and/or any Lender with respect to any Collateral or relating to Borrower.

From the date hereof and continuing through the termination of this Agreement, make reasonable efforts to make available to Agent, without expense to Agent, Borrower and its officers, employees and agents and Borrower’s Booksbooks and records, to the extent that Agent may deem them reasonably necessary to prosecute or defend any third-party suit or proceeding instituted by or against Agent or Lenders with respect to any Collateral or relating to Borrower.
