LIPA Comments Sample Clauses

LIPA Comments. Subject to the Parties entering into an appropriate joint defense agreement or other similar arrangement on mutually agreeable terms and conditions in order to protect to the fullest extent possible attorney-client privilege or any applicable privilege and the confidentiality of each Party’s Confidential Information (a “Joint Defense Arrangement”), the Service Provider shall provide the preliminary Three Year Rate Plan (as described in paragraph (B) above, which will be subject to updates prior to submission to the DPS) to LIPA for its review and comment. LIPA shall provide any recommendations, proposed modifications or objections to the preliminary Three Year Rate Plan within thirty (30) days following its receipt thereof.
