Common use of Limited Data Sets Clause in Contracts

Limited Data Sets. The Business Associate may retain, use and disclose each Limited Data Set it creates from PHI, provided that the Business Associate has entered into a data use agreement with Covered Entity with respect to the Limited Data Set that satisfies the requirements of Privacy Rule § 164.514(e)(4). The Business Associate’s retention, use and disclosure of Limited Data Sets shall be regulated by the data use agreement and shall not be subject to this BA Contract.

Limited Data Sets. The Business Associate may retain, use and disclose each Limited Data Set it creates from PHI, provided that the Business Associate has entered into a data use agreement with Covered Entity Physician with respect to the Limited Data Set Sets that satisfies the requirements of the Privacy Rule at 45 C.F.R. § 164.514(e)(4). The Business Associate’s retention, use and disclosure of each Limited Data Sets shall Set will be regulated by the data use agreement and shall will not be subject to this BA Contract.
