Limited Data Sets. The Business Associate may retain, use and disclose each Limited Data Set it creates from PHI, provided that the Business Associate has entered into a data use agreement with Covered Entity with respect to the Limited Data Set that satisfies the requirements of Privacy Rule § 164.514(e)(4). The Business Associate’s retention, use and disclosure of Limited Data Sets shall be regulated by the data use agreement and shall not be subject to this BA Contract.
Limited Data Sets. Business Associate may use PHI to create limited data set(s) in accordance with 45 CFR § 164.514(e), and may use or disclose such limited data sets for Health Care Operations, Research, or public health purposes pursuant to a data use agreement and in accordance with 45 CFR § 164.514(e) and other applicable restrictions of federal and state laws and regulations.
Limited Data Sets. Business Associate may create a Limited Data Set pursuant to 45 C.F.R. § 164.514 only as necessary and required for the purpose of performing its obligations and services for Covered Entity, provided that Business Associate complies with the provisions of this Agreement.
Limited Data Sets. Except as otherwise limited in this BA Agreement, Business Associate may create Limited Data Sets using Protected Health Information received from Covered Entity in accordance with 45 C.F.R. § 164.514 and may use and disclose such Limited Data Sets as permitted by the Services Agreement.
Limited Data Sets. Covered Entity and Business Associate agree to limit, to the extent practical and except as permitted by 45 C.F.R. § 164.502(b)(2), its uses, disclosures and requests of PHI under this Agreement to a Limited Data Set (as defined in 45 C.F.R. § 164.514(e)(2)) or, if needed by Covered Entity or Business Associate, to the minimum necessary PHI to accomplish the intended purpose of such use, disclosure or request. This provision will cease to apply on the effective date of guidance issued by the Secretary of HHS in accordance with HITECH Act § 13405(b)(1)(C).
Limited Data Sets. If and to the extent specified in the MSA or authorized in writing by the Privacy Officers of EOHHS and CCA, Contractor may use PI to create limited data sets (as defined in 45 CFR §164.514(e)(2)) for MassIT (including for CCA or EOHHS) in accord with the standards set forth in 45 CFR §164.514. Contractor’s use of PI to create a limited data set shall comply with the terms and conditions of this Agreement (including the terms of Section 3.1).
Limited Data Sets. Participant hereby grants to QCorp and its subcontractor CMQCC a non-exclusive, perpetual, irrevocable, royalty free, fully paid license to use, reproduce, aggregate, and modify Limited Data Sets created from Participant Data and Record Identifiers solely for the purposes of supporting the Oregon-MDC Program, pursuant to the terms and conditions of this Agreement, the Business Associate and Data Use Agreement attached hereto as Attachment C, and subject to HIPAA’s requirements.
Limited Data Sets. Create, maintain, use, and/or disclose Limited Data Sets based on Participant Data as set forth in Section 3.
Limited Data Sets. Participant hereby grants CPQCC a non-exclusive, perpetual, irrevocable, royalty free, fully paid license to use, reproduce, aggregate, and modify Limited Data Sets created from Participant Data solely for the purposes of supporting the CPQCC Program and/or the HRIF QCI, pursuant to the terms and conditions of this Agreement, the Business Associate Agreement attached hereto as Attachment C, and subject to HIPAA’s requirements.
Limited Data Sets. BUSINESS ASSOCIATE may use the PHI to create Limited Data Sets that satisfy the requirements of 45 CFR § 164.514(e)(2) of the Privacy Rule (“LDS”). BUSINESS ASSOCIATE may use the LDSs for BUSINESS ASSOCIATE’s Research and/or Public Health Activities. Any LDS BUSINESS ASSOCIATE creates under this Agreement or the Service Agreement will include the minimum necessary data fields required to accomplish BUSINESS ASSOCIATE’s Research and/or Public Health activities. BUSINESS ASSOCIATE will not use the LDSs to identify or contact the individuals who are the data subjects. BUSINESS ASSOCIATE will comply with the terms of this Agreement with respect to the Limited Data Sets.
