Common use of Limitation on Duty to Collect Clause in Contracts

Limitation on Duty to Collect. Custodian shall promptly notify the Master Fund whenever any money or property due and payable from or on account of any securities or other assets held hereunder for the Master Fund is not timely received by it. Custodian shall not, however, be required to enforce collection, by legal means or otherwise, of any such money or other property not paid when due, but shall receive the proceeds of such collections as may be effected by it or its agents in the ordinary course of Custodian's custody and safekeeping business or of the custody and safekeeping business of such agents.
