Liberal Construction. The Covenants hereof shall be liberally construed to promote and accomplish the objectives set forth in the Recitals.
Liberal Construction. This Credit Agreement constitutes a fully negotiated agreement between commercially sophisticated parties, each assisted by legal counsel, and shall not be construed and interpreted for or against any party hereto.
Liberal Construction. This Agreement shall be liberally construed to achieve the economic development objectives and purposes of both this Agreement and the Plan. Should any provision of this Agreement be determined to be void, invalid, unenforceable or illegal, such provision(s) shall be null and void, but the remaining provisions shall be unaffected thereby and shall continue to be valid and enforceable.

If any provision in this instrument is found to be ambiguous, any interpretation consistent with the purpose of this Conservation Restriction that would render the provision valid shall be favored over any interpretation that would render it invalid.

The parties recognize and agree that the primary purposes of this Conservation Easement are to preserve and protect the Protected Property and to improve and enhance its Conservation Values. If any provision in this instrument is found to be ambiguous, an interpretation consistent with the primary purposes that would render the provision valid should be favored over any interpretation that would render it invalid.
Liberal Construction. The provisions of this Agreement shall be liberally construed as necessary or reasonably convenient to achieve the purposes of the Authority.

The Parties hereby agree that California Civil Code Section 1654 shall not apply to the terms of this Agreement.
