Only personnel who have the appropriate external certification(s) as per Letter #6 will perform these tasks. The Company fully intends to provide its employees adequate training to perform such work. Other classifications will also evolve to support this effort. The Company and the Union have agreed in principal to work together to ensure that this effort supports both the Union’s and Company’s objective of enhanced opportunities for job security. Xxxxxx, During the recent negotiations, the Company and Union had discussions surrounding the selection process of backup train drivers. This letter is intended to clarify this selection process. Both parties acknowledge that this backup pool is essential for ensuring the uninterrupted flow of production at CMM. The backup driver pool exists to fill vacancies when existing train drivers are not available to work during the work week. This pool is not intended as a substitute for regular weekend overtime opportunities. When the need arises to increase headcount in the backup pool, the Company will post for these vacancies. Seniority will be used to populate the pool. The number of backup drivers on each shift shall not exceed the number of trains. During regularly scheduled (Monday to Friday) shifts, current 14.4’s will be used to fill in for vacations, leaves of absences, sick or extended absences. to a maximum duration of five days per vacancy. After the first five days have been covered by current 14.4’s, the backup pool may be utilized. The Company has the right to require that the same 14.4 works the entire overtime period. When all 14.4’s have been offered and have refused to work for the entire overtime period, the Company may revert to the backup pool for coverage. During weekend overtime opportunities, the backup drivers will only be used when all other train drivers have been asked to work. The Company will maintain, with a selected Supervisor on each shift, a list of available back up drivers. During regularly scheduled (Monday to Friday) shifts, current 14.4’s backup drivers will be used to fill in for vacations, leaves of absences, sick or and extended absences. to a maximum duration of five days per vacancy. After the first five days have been covered by current 14.4’sIn all other circumstances, where feasible, the backup existing train drivers will be asked for coverage. If there is a planned absence of a full week, one person from the pool may be utilized. The Company has the right to require will fill that the same 14.4 works the entire overtime period.
