Legacy Agreement and this (A&R) Agreement. The terms and conditions of the Legacy Agreement shall apply to services provided by Supplier to Customer pursuant to the Legacy Agreement or any claim or liability arising between the Parties pursuant to the Legacy Agreement with respect to periods prior to the Restated Date. The terms and conditions of this Agreement shall apply to any Services, claim or liability arising between the Parties pursuant to this Agreement on the Restated Date and with respect to periods on and after the Restated Date. However, for the avoidance of doubt, the Damages Cap is a single cumulative cap for the Legacy Agreement and this Agreement.
