Notwithstanding the above, Tenant shall have the right to enter the Premises following Lease execution in accordance with all the terms of this Lease (other than the obligation to pay rent until the stated dates) for the purpose of planning, fit up, and installing alterations (subject to Landlord approval). Prior to entering the Premises Tenant shall put all utility services in its name and pay the ongoing costs of utilities, landscape, maintenance and building service contracts.

LEASE COMMENCEMENT DATE AND LEASE TERM. Prior to entering the Premises Tenant shall put all utility services in its name and pay the ongoing costs of utilities, landscape, maintenance and building service contractsLeased Premises.

LEASE COMMENCEMENT DATE AND LEASE TERM. The term of this Lease shall begin, and the Lease Commencement Date shall be deemed to have occurred, on the Intended Commencement Delivery Date (as set forth in Article 1Section 2.4) unless either (i) Landlord is unable to deliver possession of the Leased Premises to Tenant on the Intended Commencement Delivery Date, in which case the Lease Commencement Date shall be as determined pursuant to Article Section 2.4 below or (ii) Tenant enters into possession of the Leased Premises prior to the Intended Commencement Date, in which case the Lease Commencement Date shall be as determined pursuant to Article 2.7 below (the “Lease Commencement Date” ”). Promptly following the Lease Commencement Date, Landlord shall deliver to Tenant written confirmation thereof (“Commencement Date Confirmation Notice”) which Tenant shall countersign and return to Landlord within ten (10) days following Tenant’s receipt of same. In the event Landlord does not receive the Commencement Date Confirmation Notice countersigned by Tenant within such ten (10) day period, the date set forth in such notice shall be conclusively deemed the Lease Commencement Date for all purposes under this Lease. The term of the Lease shall end on the Lease Expiration Date (as set forth in Article I1), irrespective of whatever date the Lease Commencement Date is determined to be pursuant to the foregoing sentence. The Subject to exercise of the Extension Option pursuant to Section 2.8 hereof, the Lease Term shall be that period of time commencing on the Lease Commencement Date and ending on the Lease Expiration Date (the “Lease Term”). Notwithstanding the above, Tenant shall have the right to enter the Premises following Lease execution in accordance with all the terms of this Lease (other than the obligation to pay rent until the stated dates) for the purpose of planning, fit up, and installing alterations (subject to Landlord approval). The term of this Lease shall begin, and the Lease Commencement Date shall be deemed to have occurred, on the Intended Commencement Date latest of (as set forth in Article 1a) unless either the Substantial Completion of the Landlord’s Work (iexcluding Parking Structure-P2), (b) six (6) Building G months after the date that Landlord is unable to deliver possession of has delivered the Leased Premises to Tenant on in the Intended Commencement DateRequired Delivery Condition as defined in Paragraph 2.4(a) below, in which case and (c) the Lease Commencement Date shall be as determined pursuant to Article 2.4 below or under the Building F and H Lease (ii) Tenant enters into possession of the Leased Premises prior to the Intended Commencement Datesuch latest date, in which case the Lease Commencement Date shall be as determined pursuant to Article 2.7 below (the “Lease Commencement Date” ”); provided, however, that the Lease Commencement Date is subject to advancement for Tenant Delays (as defined in the Work Letter), and subject to extension for Landlord Delays as defined in the Work Letter. The term of the this Lease shall in all events end on the Lease Expiration Date (as set forth in Article I)1, irrespective of whatever date as the Lease Commencement Date is determined to same may be extended pursuant to the foregoing sentenceArticle 15 below).
