Lawfully. Each organisation party to this Agreement is established to provide health care or social care services to the local population. Each organisation will ensure that their processing of PCD is fair and lawful, taking into account their respective duties under the common law duty of confidence, the principles of the Article 6 and 9 of the GDPR, Article 1, 8 and 10 of the Human Rights Act 1998.

Lawfully processing
(a) Customer warrants that any personal data provided directly by Customer or by Data Subjects at the instigation of Customer may be lawfully processed by Service Provider and Local Subsidiaries for the purposes of this Agreement. Security classification: Protected
(b) Customer shall not use this personal data for monitoring the behavior or the performance of Data Subjects, unless and only to the extent permitted by mandatory laws, collective agreements or employment contracts.
