Under the heading "Land Contracts", Schedule 4.16(d) hereto lists all written and oral agreements, arrangements, contracts, and commitments to which the Company is a party or entered into on behalf thereof pursuant to which the Company has any material obligation or right to purchase any developed or undeveloped real property (the "Land Contract Property") as of the date hereof. Each such parcel of developed real property included in the Land Contract Property satisfies all of the representations and warranties set forth herein concerning the Real Property.
