Labour Agreements. There are no labour agreements in effect between the Loan Parties and any labour union or employee association and the Loan Parties are not under any obligation to assume any labour agreements to or conduct negotiations with any labour union or employee association with respect to any future agreements as of the Effective Date; and the Loan Parties are not aware of any current attempts to organize or establish any such labour union or employee association.
Labour Agreements. In satisfying the requirement in Section 4.1.13, and in-line with ITC labour requirement, the Contractor will pay as part of its labour subcontracts a total compensation package that equates to the prevailing wage. Additionally, at least ten per cent of the tradesperson hours worked must be performed by registered apprentices in the Red Seal trades.

Schedule 6.01(o) attached hereto contains a true and complete list of all contracts with labour unions and employee associations to which the Companies are a party, and the Borrowers are not aware of any attempts to organize or establish any other labour union or employee association.

The Obligors have no contracts with any labour union or employee association, and are not under any obligation to assume any such contracts to or conduct negotiations with any labour union or employee association with respect to any future agreements, and the Obligors are not aware of any current attempts to organize or establish any such labour union or employee association.
Labour Agreements. Except as disclosed in Schedule 4.01(o) attached hereto there are no labour agreements in effect between the Companies and any labour union or employee association and the Companies are not under any obligation to assume any labour agreements to or conduct negotiations with any labour union or employee association with respect to any future agreements; and the Borrower is not aware of any current attempts to organize or establish any such labour union or employee association. There are no strikes or other labor disputes pending or, to the Borrower’s knowledge, threatened against the Borrower or any of its Subsidiaries. The required hours worked, payments made to the employees of the Borrower and its Subsidiaries and working conditions are in material compliance with the Fair Labor Standards Act and other applicable law dealing with such matters.
Labour Agreements. The Buyer shall fulfill the agreements (dated May 12th 1999, December 18th 1997 and July 29th 1997) attached hereto as Exhibit 4.2(D) and subsequent actions contemplated hereby.

The Company is not bound by or subject to (and none of its assets or property is bound by or subject to) any written or oral, express or implied, labour Contract, commitment or arrangement (including any collective agreement), and the Company has not recognized or made any commitments to or entered negotiations with, any trade or labour union or employee association, and no trade or labour union or employee association has requested the Company to or, to the knowledge of the Company, has sought to represent any of the employees, representatives or agents of the Company. There is no strike, grievance, slowdown, stoppage, complaint or other labour dispute involving the Company pending, or to the knowledge of the Company, threatened, or anticipated by the Company, against the Company, nor is the Company aware of any labour organization activity involving its employees in the last two years. The Company has not experienced work stoppages, slowdowns or strikes (legal or otherwise) in the last two years. No trade union has applied to have the Company declared a related employer pursuant to the Labour Relations Act (Ontario) or any similar legislation in any jurisdiction in which the Company carries on business.
