Common use of Joint Use Clause in Contracts

Joint Use. This Agreement shall be subordinate in all respects to the provisions of any existing or future agreements between State and the United States government, or any agency thereof, relative to the aircraft operating areas of the Airport, the execution of which has been or may be required as a condition precedent to the expenditure of federal funds for the development of the Airport. In the event of any such inconsistency between such agreement(s) and the operation of the Concession, this Agreement or the particular terms and conditions affected hereby shall be suspended or terminated without State being liable for any damages. This Agreement shall be subordinate in all respects to the provisions of any existing or future Joint-Use Agreement between State and the United States Navy, the United States Army, or the United States Air Force. In the event of any such inconsistency described in the preceding paragraph between this Agreement and any existing or future Joint-Use Agreement, this Agreement or the particular terms and conditions affected hereby shall be suspended or terminated without State being liable for any damages.
