Joint Payment. Owner may, at its election and without the Contractor's consent, make any payment due hereunder jointly to Contractor, any of its subcontractors, materialmen, suppliers, and any other persons or entities who may claim a mechanics' lien or materialmen's lien as a result of the Work.
Joint Payment. The Owner may make payment by joint check to a Subcontractor or Consultant of any tier, and such payments shall be deemed to have been made on account of the payee and all tiers between the payee and the Owner. Any payment made by the Owner by joint check shall not be construed as a promise to assume the debt of any joint payee, nor as a continuing obligation to make joint payments, nor as an assumption or establishment of a direct contractual relationship with the payee.

Builder may, at its election and without the Subcontractor’s consent, make any payment due hereunder jointly to Subcontractor, any of its sub-subcontractors, materialmen, suppliers, and any other persons or entities who may perfect a mechanics’ lien or materialman’s lien as a result of the Work.
Joint Payment. City shall have the right, if deemed necessary in its sole discretion, to issue joint checks made payable to Contractor and any Subcontractor(s) of any Tier. The joint check payees shall be solely responsible for the allocation and disbursement of funds included as part of any such joint payment. Endorsement on such check by a payee shall be conclusively presumed to constitute receipt of payment by such payee. In no event shall any joint check payment be construed to create any contract between City and a Subcontractor of any Tier, any obligation from City to such Subcontractor or any third party rights against City or Director.
