KEMBA is not liable for any act, failure to improper identification act or delay in acting if it is caused, in whole or in part, by any cause beyond KEMBA’s reasonable control. If we do not provide a bill payment instruction on time, if we cause an incorrect amount to be removed from an account or if we cause funds from an account to be transferred to any account other than the deposit envelopeaccount or payee’s account specified in the appropriate bill payment instruction, we shall be responsible for returning the improperly transferred funds and/or for directing any misdirected funds to the proper account or intended payee’s account. Joint Accounts. If this account is a held by more than one person, all of the joint Account, You and beneficial holders are jointly and severally liable to BLUECHIP FINANCIALS MARKET LIMITED for any and all obligations arising out of all transactions in the account and each agree to be jointly bound by all the terms and severally liableconditions of this Agreement. Joint Accounts. If this is a joint Account, You agree each person on the Account, when they signed the credit card application, has agreed to be jointly and severally liable, under the terms and conditions of this Agreement/Disclosure. From time to time, the charges may be changed. We will notify you of any Account access device changes as required by applicable law. If you use an ATM that is requested operated by us, you may be charged a fee by the ATM operator and approved by national, regional, or local network used in processing the transaction. The ATM surcharge will be debited from your account if you elect to complete the transaction. MEMBER LIABILITY – You are responsible for all EFT transactions you authorize. If you permit someone else to use an EFT service, your card, or your access code, you are responsible for any transactions they authorize or conduct on any of your accounts. Tell us AT ONCE if you believe your card has been lost or stolen. Telephoning is the best way of keeping your possible losses down. You could lose all the money in your account (plus your maximum overdraft line of credit). If a transaction as made with your card or card number without your permission, and is either a VISA or Interlink transaction, you will have no liability for the transaction unless you were grossly negligent in the handling of your account or card. Your liability for unauthorized use of your card or account will be determined under the following paragraphs for transactions that are not VISA or Interlink transactions, for transactions at ATMs, or if you were grossly negligent in the handling of your account or card.
