JOB BIDS. (a) Whenever job vacancies of a permanent nature (i.e. expected to be of more than thirty (30) days duration) occur in the bargaining unit, other than in the Labourer classification, the Corporation shall post notice thereof for a period of five (5) consecutive working days on the bulletin boards. Qualified employees shall make written application for promotion into such vacancies by signing a job notice within the aforementioned posting. All notices of vacancies shall designate the job and rate of pay for such job. The Corporation shall post the name of the successful applicant within ten (10) days after the period of five (5) days has expired. (b) Unless his employment is terminated, an employee’s job shall not be considered vacant by reason of his absence from work because of sickness, injury or other authorized leave of absence. (c) The Corporation will determine the successful applicant for a job posting by considering the skill, qualifications and present ability of the individuals applying to perform the required work, and where any of the applicants have those qualities to perform the required work and to perform it well, the employee with the greatest seniority will receive the promotion. (d) Any employee who has successfully bid under this article shall not be entitled to bid on a posted job for a period equal to the probationary period of this Agreement from the date of his successful bid, except with the mutual consent of the Corporation and the Union. (e) Should the successful applicant for the vacancy turn out to be unsatisfactory in the opinion of management after a period not to exceed thirty (30) days worked, he shall be returned to his former position. Management shall not form its opinion in a manner that is arbitrary, discriminatory or in bad faith. (f) Where no employee meets the qualifications for the posting, the Corporation shall be free to fill the job vacancy from outside sources. (g) Only the original job vacancy and the first succeeding vacancy must be posted.
JOB BIDS. Section 1. Where there is a vacancy in an existing job within the bargaining unit, and the City determines the vacancy should be filled, or a new job is created within the bargaining unit, employees desiring to bid on such job may do so as follows:
JOB BIDS. It is agreed between the Union and the Company that employees will have the right to job bid, based on their qualifications and seniority, on an annual basis as follows: a) Garage: Shift preference will be bid by journeymen mechanics every three (3) months on January 1st, April 1st, July 1st, and October 1st on the basis of departmental seniority. Apprentice mechanics will rotate shifts weekly until successfully completing the training program. No more than one apprentice mechanic will be scheduled to work on any one shift. b) Driving Division job categories and work opportunity procedures are defined in Article 10.5 a), which may be amended as necessary by agreement of the parties. In an effort to provide efficiency in bid run jobs, the Union & the Company will meet to discuss, and review job runs in an effort to jointly develop runs that are efficient to the operations. The Company reserves the right to adjust runs as necessary. It is further understood that management reserves the right of final discretion of determining bids. Such categories include five (5) day drivers (8-hour shifts), four (4) day drivers (10-hour shifts), spare drivers, finished product drivers, yard shunters and truck washers.
JOB BIDS. It is agreed between the Company and the Union that, once each year, all employees must bid and may transfer to other departments within the terminal, providing they have the necessary qualifications and seniority. For the purpose of this Schedule, the departments are defined as Grocery, Produce and Dock. The Annual Job Bid shall be held annually in the month of March. The bid will show the number of departmental openings. Each employee will be brought into the office in order of seniority to sign the bid, at which time he must sign the bid and indicate his preference. The transfer of will be affected commencing on the first Sunday of the month of April. The results of the annual job bid will be posted for at least seven (7) days prior to the annual change and the local Union's area office concerned will be given copies when completed. The appropriate Shop ▇▇▇▇▇▇▇ will have the authority to sign on behalf of any employee who is absent at the time of the annual job bid due to sickness, injury, leave of absence or vacation. Employees will only be transferred if the required qualifications are approved by the Company. Personnel transferring under the above conditions shall assume positions according to and maintaining their terminal seniority. When openings on types of equipment occur at any time, qualified employees in the department in which the openings occur shall be given preference in accordance with their seniority. This shall not be interpreted to give an employee the right to move from one truck to another, nor to give an employee a preference to bid on a new truck, but is intended to give an employee an opportunity to progress from straight truck to tractor-trailer equipment. When job openings occur in any department coming within the scope of this bargaining unit, such openings will be posted on the bulletin board for seventy-two (72) hours, Saturday, Sunday and Paid Holidays excluded, and the employees in the department affected shall have the first opportunity of bidding on such job openings and retaining their department seniority. An employee shall maintain his seniority for all purposes when he transfers from one (1) department to another, as a result of being the successful applicant for a permanent job posting.

Such vacancy shall be posted for 10 calendar days and shall show the job title and closing date allowing other IGUA Local 3 personnel employed by the Company to apply for consideration for the vacancy. (d) Any employee who has successfully bid under this article shall not be entitled to bid on a posted job for a period equal to the probationary period of this Agreement from the date of his successful bid, except with the mutual consent of the Corporation and the Union. (e) Should the successful applicant for the vacancy turn out to be unsatisfactory in the opinion of management after a period not to exceed thirty (30) days worked, he shall be returned to his former position. Management shall not form its opinion in a manner that is arbitrary, discriminatory or in bad faith. (f) Where no employee meets the qualifications for the posting, the Corporation shall be free to fill the job vacancy from outside sources. (g) Only the original job vacancy and the first succeeding vacancy must be posted. (h) It is understood by the parties that the “job bids” procedure is redundant until such a time a new job classification is established.
